Pollution Permission (CTE & CTO)

It is a big challenge for an entrepreneur to establish a new manufacturing business. Setting up a new Industry requires many approvals from Government Authorities. One of the major requirements is to obtain the Consent from the State Pollution Control Board. The new units are under compulsion to obtain consent under the Water Act, 1974 and Air Act, 1981 even before starting subsequent production. In case the unit is covered under Hazardous and Other Wastes (Management & Trans boundary Movement) Rules, 2016, E-Waste (Management) Rules, 2016, Plastic Waste Management Rules, 2016 and Bio-Medical Waste Management Rules, 2016, it shall simultaneously apply for the grant of consent under Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981.

Mining Approval

Mining is the process of extracting useful materials from the earth. Some examples of substances that are mined include coal, gold, or iron ore. Iron ore is the material from which the metal iron is produced. The process of mining dates back to prehistoric times.

The two major categories of modern mining include surface mining and underground mining. In surface mining, the ground is blasted so that ores near Earth’s surface can be removed and carried to refineries to extract the minerals. Surface mining can be destructive to the surrounding landscape, leaving huge open pits behind. In underground mining, ores are removed from deep within the earth. Miners blast tunnels into the rock to reach the ore deposits. This process can lead to accidents that trap miners underground.

An environmental Clearance Certificate is a permission provided by the regulating authority to the project proponents to undertake the construction and mining activities.

Checklist

Forest NOC/ Aravalli NOC

Introduction: Forest Clearance
Forests are the respiratory organ of the nation and provide many ecological services like oxygen, clean water, maintenance of soil moisture by checking soil erosion, etc. Forests maintain environmental stability and ecological balance. Forests with a vast variety of flora and fauna are home to biodiversity. Forests directly sequester Carbon dioxide from the atmosphere and play a critical role in checking global warming and climate change. Forests check the extension of sand dunes to prevent desertification. Healthy forest ecosystems are necessary for further land degradation in the country.

Guidelines and Procedure for Forest Clearances under the Forest Conservation Act 1980

  1. Form A is for seeking first time approval under the act.
  2. Form B is for seeking renewal of leases where approvals of the Central Government have already been obtained.
  3. Form C is for seeking permission for prospecting of minerals.

Checklist

HWRA (Bore-well permission)

Borewells & tubewells, are very similar. Both are basically vertical drilled wells, bored into an underground aquifer in the earth’s surface, to extract water for various purposes. The difference in the two lies in the type of casing used the depth of this casing and the type of soil where they are drilled.

Applicants need to obtain a No Objection Certificate (NOC) from the PHED or the concerned authority before commencing borewell drilling. The NOC is issued after assessing the feasibility and potential impact on groundwater resources.
